You’re creating on SoundCloud, which means…

SoundCloud takes less from a track than almost anyone: the licence ends when you delete it. The catch is that the wide licence was never SoundCloud's — it runs to every other user and to every site your track was embedded on, and deleting does not reach them.

What they own

Nothing, and they say it twice in a row: “Any and all Content is uploaded, owned and controlled solely by you, and not by SoundCloud.” Then: “SoundCloud does not claim any ownership rights in your Content”.

What you own

The recording, and — unusually — the off switch. The licence is non-exclusive, so the same track can go to Bandcamp, a distributor, a label, or a sync deal. You set the permissions on each upload, and the licence to other users runs only “within the parameters set by you using the Services.” Delete the track and the licences “terminate automatically”.

What you don’t

Control over where it already went. Once your track has been embedded on another site, SoundCloud “is not obligated to ensure the deletion of your Content” from that site’s servers, and offline copies can survive on other people’s devices for “no longer than 30 days from the time of deletion.” Deleting the account is a different question from deleting a track: everything in it is “irretrievably deleted … except to the extent that we are obliged or permitted to retain” it “and/or to protect our legitimate business interests.” Your comments are on different terms from your music — those licences are “perpetual and irrevocable”. And you get no answer about money here: “revenue,” “monetize” and “payout” appear zero times in this document. Payment lives in the separate Artist Terms and Fan Terms, which this contract points at and does not contain.

What they can do with it

Store it, stream it, transcode it, and run ads around it — SoundCloud’s own licence is capped at what is “necessary” to do that, “including the distribution of advertising or other promotional material on our Platform”. The bigger grant goes elsewhere: every other user, plus “operators and users” of any site your track has been embedded on, can copy it, repost it, distribute it, adapt it and “prepare derivative works of” it, royalty-free. “Sub-licensable” appears zero times in this document. “Perpetual” appears once, and it is attached to your comments, not your music.

The clauses

The grant to SoundCloud is a hosting licence

SoundCloud Terms of Use — Grant of license. Last amended August 17, 2026. ↗

By uploading or posting your Content to the Platform, you initiate an automated process to transcode any audio Content and direct SoundCloud to store your Content on our servers, from where you may control and authorize the use, ways of reproduction, transmission, distribution, public display, public performance, making available (including whether users will be permitted to listen to your Content offline) and other communication to the public of your Content on the Platform and elsewhere using the Services.

To the extent it is necessary in order for SoundCloud to provide you with any of the aforementioned hosting services, to make Content available pursuant to Platform features and user-directed activities, to undertake any of the tasks set forth in these Terms of Use, including the distribution of advertising or other promotional material on our Platform and/or to enable your use of the Platform and its features, you hereby grant such licenses to SoundCloud on a limited, worldwide, non-exclusive, royalty-free and fully paid basis.

“you hereby grant”

This is the direction that matters — you giving, not SoundCloud giving. The licence SoundCloud grants you sits in a different section and is the mirror image: “limited, personal, non-exclusive, revocable, non-assignable and non-transferable”.

Scoped by necessity

The grant is bounded by the sentence it lives in: what is necessary to host, transcode and serve your track, and to run the tasks in these Terms. It is not a free-standing right to use your music for anything they like.

Royalty-free includes the ads

Advertising sits inside the necessity clause, so SoundCloud can sell ads against your track without paying you anything under this licence. Whether you get paid at all is decided by the separate Artist Terms, not here.

The words that are absent

“Sub-licensable” appears zero times in this document. “Transferable” appears twice, both times as “non-transferable”, in the licence SoundCloud grants you. Nothing in this grant is perpetual or irrevocable.

The wide licence is not to SoundCloud — it is to everyone else

SoundCloud Terms of Use — Grant of license ↗

By uploading your Content to the Platform, you also grant a limited, worldwide, non-exclusive, royalty-free, fully paid up license to other users of the Platform, and to operators and users of any other websites, apps and/or platforms to which your Content has been shared or embedded using the Services ("Linked Services"), to copy, listen to offline, repost, transmit or otherwise distribute, publicly display, publicly perform, adapt, prepare derivative works of, compile, make available, communicate to the public and otherwise use (collectively, “ Use ”), your Content utilizing the features of the Platform from time to time and within the parameters set by you using the Services. You further grant to SoundCloud a limited, worldwide, non-exclusive, royalty-free, fully paid up license to Use solely in connection with social features on the Platform your username, your profile picture, or other elements of your likeness (“ Likeness ”), and information about your activities on the Platform (such as likes, reposts or plays) or relationships (such as follows), next to or in connection with your account, the accounts of other users and Content with which you engage on the Platform.

Read the recipient, not the adjectives

The adjectives here are the same mild ones SoundCloud took for itself. What is different is who receives them: every other user, and the operators of any website or app where your track has been embedded. SoundCloud never needed the word “sub-licensable” because this sentence hands the rights out directly.

Derivative works

“adapt, prepare derivative works of, compile” is the language that reaches remixes, edits and compilations. It runs to users and to Linked Service operators on a royalty-free licence.

The one brake

“within the parameters set by you using the Services” is the limit on the whole grant, and it is the permissions tab on each track — downloads, offline listening, embedding. Those settings are the contract term you actually control, and they are set per upload.

Your likeness is narrower

The likeness grant is a separate sentence and is confined to “social features on the Platform”. It covers your username, profile picture and activity data. It does not mention advertising or sponsored content.

Deleting a track ends the licence — deleting a comment does not

SoundCloud Terms of Use — Grant of license ↗

The licenses granted in this section are granted separately with respect to each item of your Content that you upload to the Platform. Licenses with respect to audio Content, and any images or text within your account, will (subject to the following paragraph of these Terms of Use) terminate automatically when you remove such Content from your account. Licenses with respect to comments or other contributions that you make on the Platform will be perpetual and irrevocable, and will continue notwithstanding any termination of your account.

A cancel button that exists

This is the sentence most platforms do not have. Take the track down and the licence ends by itself — no request, no notice period. It is granted per item, so removing one track ends that track's licence and leaves the rest running.

The split inside the same clause

“Perpetual” and “irrevocable” appear in this document attached to comments and other contributions, not to your audio. It is the same paragraph, one sentence later, on the opposite terms.

“subject to the following paragraph”

The automatic termination is qualified before it finishes. The paragraph it points to is the one below — what leaves the platform does not come back.

What deletion cannot reach

SoundCloud Terms of Use — Grant of license, and Termination ↗

Removal of audio Content from your account will automatically result in the deletion of the relevant files from SoundCloud’s systems and servers. However, notwithstanding the foregoing, you hereby acknowledge and agree that once your Content is distributed to a Linked Service, SoundCloud is not obligated to ensure the deletion of your Content from any servers or systems operated by the operators of any Linked Service, or to require that any user of the Platform or any Linked Service deletes any item of your Content. Furthermore, if you authorize any of your Content to be available for offline listening, after deletion of an item of your Content or removal from the ability for other users to listen to the applicable Content offline, the applicable Content may still be temporarily available to other users of the Platform who saved the applicable Content for offline listening on their devices, but no longer than 30 days from the time of deletion.

…

Once your account has been terminated, any and all Content residing in your account, or pertaining to activity from your account (for example, data relating to the distribution or consumption of your Content), will be irretrievably deleted by SoundCloud, except to the extent that we are obliged or permitted to retain such content, data or information for a certain period of time in accordance with applicable laws and regulations and/or to protect our legitimate business interests.

…

The provisions of these Terms of Use that are intended by their nature to survive the termination or cancellation of this Agreement will survive the termination of this Agreement, including, but not limited to, those Sections entitled Your SoundCloud Account … Grant of License …

Embeds outlive the upload

A Linked Service is any site, app or platform your track was shared or embedded to using SoundCloud's player or widget. SoundCloud deletes its own copy and takes on no duty to chase those, or to make any user delete theirs.

30 days, stated

If you enabled offline listening, downloaded copies stay playable on other people's devices for up to 30 days after you delete. That number is in the text, and it applies only to the offline feature you switched on yourself.

A third exception, and it is theirs

Two of the exceptions are permissions you set at upload — embedding and offline listening. The third is not. On account termination SoundCloud keeps whatever it is “obliged or permitted to retain … and/or to protect our legitimate business interests”, and it is SoundCloud that decides what its legitimate business interests are. The window is “for a certain period of time”, which the document never fills in, and no other clause fills it in either: “retention”, “backup” and “archive” appear zero times.

“Grant of License” is on the survival list

The Termination section names Grant of License among the sections that survive. The list self-limits — it reaches only provisions “intended by their nature to survive” — and the provision in Grant of License that survives by its nature is the comment licence, which says so itself: it continues “notwithstanding any termination of your account”. Read that way, deleting a track still ends that track’s licence. The document does not settle it either way: it names the section, not the sentence, and anyone relying on the off switch should know the section is on the list.

The AI clause, read exactly as written

SoundCloud Terms of Use — Grant of license ↗

We will not use your content to train generative AI models that aim to replicate or synthesize your voice, music, or likeness without your explicit consent, which must be affirmatively provided through an opt-in mechanism.

For the avoidance of doubt, neither SoundCloud nor any third party is allowed to use, copy or reproduce any Content delivered to the Platform under separate agreements, which is owned or controlled by third party rights holders (including artwork, images, logos, audio and audiovisual recordings (and any part thereof), underlying musical works and lyrics, and metadata) for the purposes of informing, training developing (or as input to) artificial intelligence technologies without authorization from the applicable rightsholders.

Opt-in, not opt-out

Consent has to be “affirmatively provided”. Silence is not consent under this sentence, and neither is a default setting you never touched.

The promise carries its own scope

It covers generative models “that aim to replicate or synthesize your voice, music, or likeness”. That is the boundary the sentence draws itself; training with a different aim is not what this sentence addresses, and no other sentence in the document does.

Two kinds of music, two paragraphs

The second paragraph is about catalogue “delivered to the Platform under separate agreements” by rights holders — distributor and label deliveries — not the track you uploaded yourself. The document keeps the upload and the delivered catalogue apart, and gives each its own sentence.

If it goes wrong, money is the only remedy

SoundCloud Terms of Use — Limitation of Liability, and Applicable law and jurisdiction ↗

IN NO EVENT SHALL SOUNDCLOUD’S AGGREGATE LIABILITY TO YOU UNDER THIS AGREEMENT EXCEED THE GREATER OF 100 EURO OR THE AMOUNTS (IF ANY) PAID BY YOU TO SOUNDCLOUD DURING THE PREVIOUS TWELVE (12) MONTHS FOR THE SERVICES GIVING RISE TO THE CLAIM. … You acknowledge that, in the event of a breach of this Agreement by SoundCloud or any third party, the damage or harm, if any, caused to you will not entitle you to seek injunctive or other equitable relief against SoundCloud, including with respect to your Content, and your only remedy shall be for monetary damages, subject to the limitations of liability set forth in these Terms of Use.

100 euro

That is the stated ceiling on everything SoundCloud could owe you under this agreement, unless you have paid them more than that in the previous twelve months.

No order to stop

The waiver names your Content specifically. If SoundCloud used your track in a way this agreement does not allow, the remedy written here is damages, not an order making them stop. The same section keeps SoundCloud's own right to seek equitable relief intact.

It may not stay SoundCloud

Under Assignment to third parties, “SoundCloud may assign its rights and (where permissible by law) its obligations under this Agreement, in whole or in part, to any third party at any time without notice, including without limitation, to any person or entity acquiring all or substantially all of the assets or business of SoundCloud.” You cannot assign it back the other way without their written consent.
